How much does it cost to hire a personal injury lawyer?

How long do I have to file an injury claim in Kentucky or Indiana?
Kentucky generally gives you one year. Indiana gives you two. Kentucky motor vehicle claims run on a separate two-year clock under the Motor Vehicle Reparations Act (KRS 304.39-230), measured from the crash date or your last PIP payment, whichever is later. Miss the deadline and the court dismisses your case no matter how strong it is. Call before you count on any of these dates.
What should I do in the first 48 hours after a crash?
Get medical care first, even if you feel fine. Then report the crash, photograph the scene and the vehicles, collect the other driver’s insurance information, and get witness names. Do not give a recorded statement to the other driver’s insurer. Adjusters move fast in the first week, and there is a reason for that.
How do I know if I actually have a case?
You have a case if someone else’s negligence caused you harm and the filing deadline has not passed. The real questions are whether liability can be proven, whether there is insurance or assets to collect from, and whether your damages are documented. One free consultation answers this. Not every call becomes a case, and we will tell you straight either way.
Should I talk to the insurance adjuster before I call a lawyer?
Report the crash to your own insurer. Do not give a recorded statement to the other side. Adjusters are trained to lock in early statements that limit what you can claim later, usually before you know how badly you are hurt. You are not required to give the at-fault driver’s insurer a statement. Let your lawyer handle that call.
Is Kentucky a no-fault state?
Yes, but with a choice. Kentucky is one of only three choice no-fault states, along with New Jersey and Pennsylvania. Under the Motor Vehicle Reparations Act (KRS 304.39), your own policy pays up to $10,000 in Personal Injury Protection for medical bills and lost wages regardless of who caused the crash. In exchange, your right to sue for pain and suffering is limited until you cross a threshold. Drivers may reject no-fault in writing with the Kentucky Department of Insurance.
When can I sue for pain and suffering in Kentucky?
Once you cross the tort threshold. Under KRS 304.39-060, you can pursue pain and suffering when your medical expenses exceed $1,000, or when the crash caused a broken bone, permanent disfigurement, permanent injury, or death. Most serious injuries clear that threshold within days of treatment. Once it is crossed, every category of damages opens up, including future medical costs and lost earning capacity.
What happens if I was partly at fault?
In Kentucky, you can still recover. Kentucky uses pure comparative fault under KRS 411.182, so your recovery is reduced by your percentage of fault with no cutoff. If you are 30% at fault, you collect 70%. Indiana is stricter. Indiana uses modified comparative fault under Indiana Code 34-51-2-6, and at 51% or more fault you recover nothing.
How is Indiana car accident law different from Kentucky law?
Indiana is a fault state with no PIP requirement. The at-fault driver’s insurance pays, there is no threshold to clear before claiming pain and suffering, and you have two years to file under Indiana Code 34-11-2-4. Kentucky runs a no-fault PIP system with a $1,000 threshold and a one-year general deadline. The same crash on the other side of the Ohio River is a different case.
What is the deadline to sue a city, county, or government agency?
Far shorter, and missing it ends the claim. Indiana’s Tort Claims Act requires notice within 180 days for a city or county and 270 days for the state. In Kentucky, an injury from a defective city street or sidewalk requires written notice to the city within 90 days under KRS 411.110, and claims against the Commonwealth go to the Board of Claims within one year. Do not wait on these.
What types of cases does the Karl Truman Law Office handle?
Injury and disability claims across Kentucky and Indiana. That covers car, truck, motorcycle, pedestrian, and bicycle accidents; workers’ compensation and workplace injuries; veterans’ disability and Social Security Disability; nursing home abuse; wrongful death; dog bites; traumatic brain and spinal cord injuries; maritime and Jones Act claims; and child sexual abuse cases. If you are not sure your situation fits, call and ask.
Can I file a workers' compensation claim and a lawsuit at the same time?
Often, yes. Workers’ compensation is a no-fault system that bars most suits against your employer, but it does not block a claim against a negligent third party. If a subcontractor, a driver, a property owner, or an equipment manufacturer caused your injury, that is a separate claim stacked on top of your benefits. In Kentucky you must report the injury to your employer as soon as practicable and file within two years under KRS 342.185.
What is the difference between VA disability and Social Security Disability?
Different agencies, different standards, and you can receive both. VA disability compensates service-connected conditions on a percentage rating, so partial disability still pays. Social Security Disability Insurance is all or nothing and requires that you cannot perform substantial work. A VA rating does not automatically qualify you for SSDI. Karl Truman is accredited to represent veterans before the Department of Veterans Affairs.
Can I still file a Camp Lejeune claim?
No. The Camp Lejeune Justice Act filing window closed on August 10, 2024, and the Department of the Navy no longer accepts new administrative claims. Claims filed before that date remain active. The Elective Option settlement program is still paying out and bellwether trials are moving in the Eastern District of North Carolina. Who can file a wrongful death claim?
The personal representative of the estate files, not the family directly. In Kentucky, the recovery then passes to surviving family under KRS 411.130. Indiana allows two years from the date of death. Kentucky’s deadline is shorter and turns on when the personal representative is appointed, which makes opening the estate an urgent first step. Do not assume you have time.
How long will my case take?
Most injury cases resolve in months, not years. A clear liability case settles quickly once treatment is finished. Disputed fault, catastrophic injuries, and trial all add time. The biggest factor is your medical treatment, because nobody knows what a case is worth until we know how you heal. Settling before you finish treating is how people leave money on the table.
Will my case go to trial?
Probably not. The large majority of injury cases settle. But cases settle for more when the other side believes you are willing to try it. Karl Truman is certified in civil trial practice by the National Board of Trial Advocacy and has tried cases in state and federal court in Kentucky and Indiana. We build every file as if a jury will see it.
What is my case worth?
No honest lawyer answers that on the first call. Value depends on medical bills, lost wages, future treatment, permanency, the available insurance limits, and your share of fault. In Kentucky, your recovery is reduced by your fault percentage. Anyone who quotes a number before reviewing your records and the policy limits is guessing. We give you a range once we know the facts.
What happens after I hire you?

We gather medical records, the police report, and wage documentation, then present a demand once treatment is complete. If the offer is inadequate, we file suit. You focus on healing.
Will I have to give a deposition?
Only if your case is filed in court, and we prepare you before it happens. Most clients never see a courtroom because most cases settle. If your case is litigated, expect a deposition, which is a recorded question-and-answer session with the other side’s lawyer. We sit down with you and walk through it first. No surprises.
Why is Karl Truman called the Colonel?
Because he earned it. Karl Truman was commissioned a Second Lieutenant through Army ROTC at the University of Kentucky in 1983 and retired as a Lieutenant Colonel in 2009 after 28 years of service. That is where “Count on the Colonel” comes from. It is also why this firm treats veterans’ disability work as more than a practice area. He has represented injured people in Louisville and Jeffersonville since 1991.
Is the firm licensed in both Kentucky and Indiana?
Yes. Karl Truman is licensed in both states and admitted to the U.S. District Courts for the Western and Eastern Districts of Kentucky and the Northern and Southern Districts of Indiana. In Kentuckiana that matters, because which side of the river you were hurt on changes the deadline, the insurance rules, and the fault standard. You do not need two firms.
