Kentucky Personal Injury Law: Key Facts for Every Client

Kentucky Statute of Limitations

Personal injury: 1 year from the date of injury

Wrongful death: 1 year from the date of death

Medical malpractice: 1 year from discovery of injury, or 5 years from the act, whichever is shorter

Kentucky Comparative Negligence

Kentucky follows a pure comparative negligence rule codified in KRS 411.182. Under this rule, a plaintiff can recover compensation even if they were 99% at fault. Their damages are reduced proportionately by their percentage of fault. This is a plaintiff-friendly standard and more generous than Indiana’s modified comparative fault rule. However, insurance companies use KY’s comparative negligence rules aggressively to shift blame and reduce settlements.

Kentucky No-Fault / PIP Insurance

Kentucky is a choice no-fault state. Most automobile insurance policies include personal injury protection (PIP) coverage. PIP pays your medical bills and lost wages up to the policy limit regardless of who caused the accident. You must exhaust your PIP coverage or meet the threshold ($1,000 in medical expenses, or a qualifying serious injury such as a bone fracture, permanent injury, or disfigurement) before you can sue the at-fault driver for non-economic damages. You can opt out of no-fault coverage in writing.

Kentucky Dog Bite Law

Kentucky is a strict liability state for dog bites. Dog owners are liable for bites regardless of prior history or knowledge of aggression. You do not need to prove the owner knew the dog was dangerous.

Kentucky Workers’ Compensation

Kentucky workers’ compensation: employees generally choose their own treating physician (unless employer has a managed care plan). The filing deadline is two years from the date of injury. A 30-day written report to employer is required. Appeals go to the Workers’ Compensation Board within 30 days of a denial.
