Generally no. Workers’ compensation is the exclusive remedy against your employer. However, if a third party contributed to your injury, such as a negligent property owner, contractor, subcontractor, or equipment manufacturer, you can file a personal injury lawsuit against them. This is separate from and in addition to your workers’ comp claim.
What is the deadline to report a construction site injury?
