What if my workers' comp claim was denied?
You have the right to appeal. In both Kentucky and Indiana, you have 30 days to appeal a denial to the Workers’ Compensation Board. If you are not satisfied with that decision, you can appeal further to the Court of Appeals. We handle every level of this process.
Can I also sue my employer for a workplace injury?
Generally no. Workers’ compensation is the exclusive remedy against your employer. However, if a third party, such as a negligent contractor, a property owner, or a defective equipment manufacturer, contributed to your injury, you can file a separate personal injury lawsuit against them. This claim is not limited by workers’ comp and can include pain and suffering damages.
What wage replacement does workers' comp provide?
In Indiana, you receive Temporary Total Disability payments equal to 2/3 of your average weekly wage, up to a maximum of $600 per week. In Kentucky, TTD is 66-2/3% of your average weekly salary. These payments continue until you reach maximum medical improvement or return to work.
