Understanding Wrongful Death Claims

Kentucky wrongful death law is grounded in the state constitution and codified in Kentucky Revised Statute 411.130. When a person’s death results from another’s negligence or wrongful act, the law provides the right to pursue damages. If the conduct was willful or grossly negligent, punitive damages may also be recovered.

Indiana’s wrongful death statute similarly establishes the right to seek damages when wrongdoing causes death. However, key differences from Kentucky apply. Indiana does not allow punitive damages in wrongful death cases. Indiana caps damages at $300,000 when the decedent was unmarried and had no children. Other caps apply under specific circumstances.

Critical Deadlines

In Kentucky, the wrongful death statute of limitations is one year from the date of death. In Indiana, it is two years. These deadlines are strict. Contact us immediately.

Why Wrongful Death Claim Cases Are Different

  • 1

    KY vs. IN Key Differences

KY has no wrongful death damage caps and allows punitive damages. IN caps damages at $300,000 for unmarried decedents without children and does not allow punitive damages. Knowing which state's law applies and how to maximize recovery under it is critical.

  • 2

    Who Can File

In KY, the personal representative of the estate files. In IN, the personal representative files for adult decedents; parents or guardians file for child deaths. A child in IN includes those under 20, or 23 if still in school.

  • 3

    What Can Be Recovered

Medical costs, funeral and burial expenses, lost income, loss of companionship and consortium, and in appropriate KY cases, punitive damages. We calculate the full scope of your family's loss.

  • 4

    Compassionate Representation

We handle wrongful death cases with the gravity and compassion they demand. Karl has personally handled cases for families he knew. This work matters to us on a human level.

Frequently Asked Questions

Comprehensive answers about personal injury law in Kentucky and Indiana. Find the information you need to make informed decisions about your case.

  • How long do I have to file a wrongful death claim?

n Kentucky, the statute of limitations is one year from the date of your loved one’s death. In Indiana, it is two years. These are strict deadlines. Do not wait. Contact us immediately.

  • Who can file a wrongful death claim in Kentucky?

Kentucky law requires the personal representative of the deceased’s estate to file. Damages recovered are distributed to surviving family members including spouses, children, parents, and in some cases others named in the will.

  • Who can file a wrongful death claim in Indiana?

For adult decedents, the personal representative of the estate files. When the decedent is a child, which Indiana defines as under age 20, or under 23 if enrolled in school, one or both parents or a legal guardian must file the claim.

  • Are there damage caps on wrongful death compensation?

In Kentucky, there are no caps on wrongful death damages, and punitive damages are available when the conduct was willful or grossly negligent. In Indiana, damages are capped at $300,000 when the decedent was unmarried and had no children. Punitive damages are not available in Indiana wrongful death cases. Other statutory caps may apply in specific circumstances.

  • Can I still file a wrongful death claim if there was also a criminal case?

Yes. Civil wrongful death cases are entirely separate from any criminal proceedings. A criminal conviction can strengthen your civil case, but you do not need a conviction to succeed in a civil wrongful death claim. The civil standard of proof is lower than the criminal standard.

  • What compensation can be recovered in a wrongful death case?

Medical expenses before death, funeral and burial costs, lost income and benefits the decedent would have earned, loss of companionship and consortium, and in Kentucky cases with willful or grossly negligent conduct, punitive damages.

  • How much does a wrongful death attorney cost?

Nothing upfront. We work on contingency. You pay nothing unless we win.
